Here are the basics: You need to show damages (you were hurt) as well as liability (somebody else caused the accident).
Damages translate to monetary awards, and liability translates to someone else’s responsibility. Damages are the end goal of personal injury litigation, but you can’t get there without Liability.
You can’t undo broken bones or the pain and suffering of surgeries and trauma, but you can translate those damages into a dollar amount. Certain injuries are worth more or less money – but that’s where lawyers come in, because it’s our job to know how much each injury is worth. Severity and duration are your key factors.
There are different types of damages:
- General Damages: This is your pain and suffering. Losing a hand is worth more than severing a finger. It’s absurd but true. Some injuries are minimally compensated for despite the amount of pain and suffering they cause, and some are an insurance company’s nightmare.
- Special Damages: These are your expenses for hospitals, doctors, and whatever else the injuries cost you. These are your out-of-pocket costs.
- Lost Wages: If you are unable to work due to your injuries, you might be eligible to sue to receive the money you were not able to earn at work, and if you’re permanently disabled, you could be eligible to receive money to cover future lost wages.
- Wrongful Death: If your loved one is killed in an accident, this action attempts to put a monetary value on that death. Anyone who has lost someone dear knows the truth of this: there is no amount of money that can make up for the loss of your loved one, but that doesn’t mean that whoever is responsible for that death should be off the hook just because of that.
- Survival Action: This action is paired with a wrongful death action to account for the pain and suffering the deceased was forced to endure as he or she passed away. It is a horrible thing to think of and an even more horrible thing to attempt to put a dollar amount on, but it’s a necessary evil for the same reason as the wrongful death.
